Jeanine Pirro, the U.S. attorney for Washington, D.C., stated at a news conference that Lakanwal would be charged with three counts of assault with intent to kill while armed and possession of a firearm during a crime of violence. However, if the National Guard members do not survive, the charges could be elevated to first-degree murder.
